1. Scope

These General Terms and Conditions exclusively govern the contractual relationship between CuraCap Schweiz GmbH (hereinafter "Provider") and the customer in the version applicable at the time of the order.

Deviating terms of the customer shall not apply unless the Provider expressly agrees to their validity in writing.

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

By clicking the "Order" / "Order with payment" button, the customer submits a binding offer to purchase the goods in the shopping cart.

The Provider confirms receipt of the order without delay by email. This order receipt confirmation does not yet constitute acceptance of the contract. The contract is concluded upon shipment of the goods or by a separate order confirmation by email.

If the Provider cannot accept the order, the customer will be informed without delay and any payments already made will be refunded.

3. Contract language, contract storage

Contract languages are German and English. In case of conflicts, the German version prevails.

The contract text is stored by the Provider and sent to the customer with the order confirmation in text form (email). The customer also receives an invoice in PDF format by email.

4. Delivery

Delivery is made from the Swiss warehouse of CuraCap Schweiz GmbH within Switzerland and to Liechtenstein. The shipping carrier is Swiss Post (Post CH AG).

Expected delivery time is 1–3 business days after order receipt. Should a product be temporarily unavailable, the customer will be informed without delay.

5. Prices and shipping costs

All prices are in CHF. CuraCap Schweiz GmbH is not subject to VAT under Art. 10 Swiss VAT Act (annual turnover below CHF 100,000); therefore no VAT is charged.

Within Switzerland, no shipping costs are charged. The prices stated in the shop are final prices; no additional costs apply.

The Provider reserves the right to adjust prices at any time. The prices stated at the time of the order apply to that order.

6. Payment

Payment is processed via the payment service provider Stripe Payments Europe Ltd. (Ireland) — for Swiss customers on behalf of CuraCap Schweiz GmbH. Available payment methods: credit card (Visa, Mastercard, American Express), Twint, Apple Pay, Google Pay, PayPal, Stripe Link.

The purchase price is due for payment upon conclusion of the contract.

The Provider reserves the right to exclude individual payment methods without giving reasons.

7. Retention of title

The delivered goods remain the property of the Provider until the purchase price has been paid in full.

8. Right of return

Details of any right of return are set out in our separate return notice at https://curacap.ch/en/right-of-withdrawal.

9. Warranty for defects

Statutory warranty provisions apply (Art. 197 et seq. Swiss Code of Obligations). The limitation period for material defects on new goods is two years from receipt of the goods.

In case of defects, customers are kindly asked to contact kontakt@curacap.ch. We process defect notifications within 14 days.

10. Liability

The Provider is liable without limitation for damages arising from injury to life, body or health resulting from a negligent or intentional breach of duty, and for other damages resulting from an intentional or grossly negligent breach of duty.

In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract.

11. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final provisions

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall not be affected.
